DUI
What Happens If You Are Charged With A DUI
Drinking and driving is illegal in every state in America. The most common charge for this offense is known as “driving under the influence if alcohol,” often referred to simply as a DUI. DUIs are one of the most common misdemeanors issued in the United States, and can be a very costly charge to deal with.
The Law
Laws concerning DUIs vary from state to state; generally, a person can be found guilty of a DUI by operating a motor vehicle with a blood alcohol concentration (BAC) of .08% or higher. Although a DUI is a misdemeanor, it can carry very serious consequences, legally and financially. Depending on the circumstances, a person convicted of a DUI can even serve jail time in some states. Average fines for a DUI are anywhere from approximately $500 to over $2,000.
What To Expect
If you have been consuming alcohol and get behind the wheel of a car, you are breaking the law. Should you be pulled over by law enforcement, you may be asked to participate in a Field Sobriety Test. The officer will ask you to perform certain rudimentary physical acts to determine if you are showing signs of intoxication.
Depending on how you do on the Field Sobriety Test, the officer may ask you to perform a Breathalyzer test. This test can calculate whether your BAC is higher than the legal requirements of a DUI. If so, you will be arrested and booked into jail.
DUIs are quite common; seek adequate legal advice if you are charged with one.
